The dispute occurred when the mother in law and father in law refused to transfer the property ownership OR pay back the money used to purchase the residence. They had verbally agreed to do so during the initial transaction but have since then refused to do so. My friend hopes for the will of that property to go to his son, however the mother in law and father in law want the home to go to their two sons.. . The mother in law and father in law as well as one of the sons have lived in that property for quite some time while my friend contacted them every year to transfer the name to him or his wife (their daughter). They have so far refused to do so, even while my friend had agreed not to force them to vacate which is their primary fear.. . My friend contacted a lawyer and they are all set to bring the issue to court. Legally speaking, who has the leverage and based on what you know about the law...what compromise is likely to occur based on a court ruling?. He did not purchase the home under his name or his wife's name because he lives in the United States and wished for the transfer to happen once he visits India. He was at the time a green card holder and is now a citizen (if that helps). The property was sold for a bargain price for a limited time and he could not make the trip because he was very ill. His in laws lived in the property paying rent to the previous owner. The in laws of my friend agreed that he would send the money andthey would go through the purchasing proccess AND continue to reside in the residence. I believe under the Benami Prohibition Act, the government can aquire the property and penalize both parties without any compensation for the aquired property..
