IMHO and not legal or moral advise, it appears as though the legislature provides that the health care representative has (almost) the same authority to act over the incapacitated person as the incapacitated person could if they were not incapacitated (stepping into their shoes). Of course the health care representative would have to be appointed by the then lucid grantor (which form usually says the same thing).. .
