I am as above on my fathers estate. He is very demented and can no longer make any decisions. It states in trust that if he cannot make decisions then it is me that act alone. Prior to his dementia he took out assets from a trust acct and gave as personal loans. My question is do those personal loans have to be split with other beneficiaries or can the proceeds go to whom I feel is most needy? Also, I had to reinvest some of his assets due to the market and got a much higher interest and very secure. So that also is a personal loan? My question is once it is taken out of a company that is in said trust and my father passes, what ramifications are there for me.? I am trying to keep my father afloat here. He is 88 and I just picked 100 as when he will pass, just to be on the safe side. Our financial person says that I am doing great. We moved and do not have our attorney now, but all is in a living trust. If I knew it would be this hard, I would have passed and I do not get paid anything for doing these two jobs and have to continually help in my fathers care as he is in assisted living. Help please!.

It will be easier once you're married. marriage is considered a life changing event that constitutes a name change without a huge fee, be it you or your child.. I believe he will have to legally "adopt" her.. Go to the courthouse, town hall, or whatever handles legal situations in your area and ask for forms for a petition for name change.. I know here in Oklahoma, it's via the state department of health in oklahoma city. For your state, it could be different though.. Call around, for a possible stepping ground, call the local health department or hospital and try to follow the chain up.. Once you get to the people that can change the birth certificate, they will be able to tell you exactly what you would need to do

Last week when I called, the rep told me I must put in a 30 day notice. Today is exactly 30 days away from the contract termination. So I call in.. . The rep today told me to call when I really want to cancel, because cancellations take effect immediately?. . I'm worried I'm going to call on August 22nd and they're going to tell me "ok your 30 days start now, and we're going to bill you 30 more days".

I know what your getting at, and yes. Its just not really called Power of Attorney. A living will gives the person named the right to make medical decisions, in certain situations, if you are incapacitated. Although most scenarios are covered under the living will, on whether you want to be kept alive or not. . Power of Attorney is handing over all legal rights, letting that person act as you.. . *** Yea they are two different things that get filled out at once. It must be a risky surgery. I hope the best for you. Living will is for medical decisions. PoA is for you to give a trusted friend or family member rights and access to all of your assets. But can be set up in such away where you would have had to pass away first. Just helps get past red tape and saves your family thousands having to have a lawyer do the leg work.
