• A. CRAIG EILAND was born in 1962 into a family of small businessmen, farmers and ranchers in Stanton, Texas. He was a star athlete at Stanton High School, achieving all-district honors on football, basketball and track.

  He lettered in football at Baylor University, graduating in 1984 with a BBA in Business Administration. In 1987, he received his J.D. from Baylor School of Law.

  After working on a ranch in the Australian Outback, Eiland moved to Galveston in February 1988 and joined the law firm of Mills, Shirley & Bassett, the state's oldest law firm. He left the firm after two years to work for Houston attorney Ernest H. Cannon. In 1992, Eiland opened his own law practice, with offices in Houston and Galveston.

  A Democrat, Eiland was elected to serve in the 74th legislature, his first public office. He served on the Business and Industry and the State, Federal, & International Relations Committees in 1995. He now serves on the Appropriations and Insurance Committees for the 75th Session.

  Eiland is married and lives on the West end of Galveston Island and is a member of First Baptist Church in Galveston.

Here's the situation: Daughter is both executor and has unlimited and durable power of attorney. She wishes to sell her father's properties to pay for medical expenses and home care as he is unable to take care of himself. However her brother (her father has only two children) claims this is unfair as he expects to be given a share upon his father's death. So she has decided to come to an agreement with him and give him 1/2 of everything - the other half to be used for his medical and home care expenses. Is she allowed by law to do that? His living will has no mention of what to do with his property/assets. Thank you for the help.. The half would be enough to pay for all his existing medical bills with some left for future expenses. And she's agreeing to it because the brother is causing her father a lot of stress by calling him at the care facility and poisoning his mind that she is using the money for her personal gain (which is very far from the truth). The father has dementia and forgets the conversation the next day, but the people working there inform her that whenever he calls him he goes on a fit and she's concerned he might suffer another stroke because of it. And they're not allowed to refuse the call due to him being an immediate relative, and the fact that his dad does want to talk to him. So she can think of no other way to stop him from stressing out her already very sickly dad..

What is the best legal form for my small business?

Before I knew about all the laws that protect consumers, I agreed (over the phone) to pay a collection agency a per month payment. After a while I noticed the interest didn't match up. I asked over the phone how they calculated it and they couldn't answer. I decided with a payment I'd send them a debt verification letter. About 4 days after they got my letter (certified), I got a letter for the same account from another creditor. The agency sold my account. I sent the new agency a letter as well, without a payment nor would I agree to anything over the phone. To date, I have not heard back from either creditors and its well past 30 days. I'm now getting nasty phone calls from an attorney's credit collections office. I wouldn't agree to anything over the phone and told them to send me something in writing. They told me they have and would not send anything more. Since they left a reference number on my voicemail, was I doing the right thing by sending them the same letter to?.
