If the suit had gone forward several interesting issues were raised. Was there standing to sue the CARB members individually or could they have counter sued requesting attorney fees and damages?. . While CARB certainly has the right to police the sky's of California and this has nothing to do with interstate commerce, it is another State's right vs Federal Jurisdiction that presents the problem. CARB predated the EPA by about 3 years and although federal law typically overrides, states were given the option to follow the EPA or CARB... which presents a nightmare to auto manufacturers who must then lobby in many capitals to try and reduce or eliminate regulation. It also increases the potential burden. Although California may only require 1 or 2% of the cars to be ZEV (Zero Emission Vehicles), if this is multiplied by many states the financial investment is much larger.. . The auto industry responded my making cars and seeming to comply but also did all they could to make the cars not be accepted. They were only leased not sold, they were very limited and hard to get. Limited advertising was dark and uncharacteristically uninviting for the auto industry. All in all it looks like a substantial lack of any "good faith" effort to comply with the regulations and further seemed like an overt attempt to build a case against the ZEV. Unofficial waiting lists showed a demand far exceeding supply.
