Husband and wife EACH have an estate of $5,250,000 in assets. Further, the husband has a life insurance policy of $1,000,000. In this HYPOTHETICAL instance (not real, just trying to learn about estate tax planning), does the ownership of the life insurance policy really matter? If the husband owned the policy with his wife as the beneficiary and he dies, it gets included in his gross estate but deducted due to the marital deduction. But if his wife owns the policy and he dies, then it's not included in his estate either. I can see where ownership becomes important in cases where one spouse owns significant assets and the other spouse doesn't, but is ownership as big of an issue if each spouse's estate is near or exceeds the $5,250,000 exemption?. If the insured individual OWNED the life insurance policy, then the value of the policy IS INCLUDED in their gross estate at their death. If the beneficiary is their wife, then it gets removed due to the marital deduction. I am not talking about avoiding probate, I am talking about Federal estate tax. Section 2042 of the Internal Revenue Code..

Probably not. First, if the power of attorney was signed after the accident, when brother was already legally incapable, the POA is not valid.. . Second, it depends on what the POA says if it is valid. It may be "general" or "limited" or "special".. . Third, if brother is a minor (and that is why his parents are involved), then the parents have the power and brother couldn't give anyone a POA.. . If your friend wants to fight for what he thinks is in brothers best interest, he will need to file for a conservatorship to have brother declared incompetent and then try to set aside the decisions brother made in the lawyers office.. . That's a tough one.
