Your Mother needs an attorney or a solicitor in the British Virgin Islands ASAP. Your Mother should not sign ANYTHING before she talks with one. Does she know the name of the attorney or solicitor who is handling the Probate in the BVI? It would probably be on the papers that her sister wants your Mother to sign. Please be aware that in the BVI the Executor (not executive) receives a payment, over and above their inheritance, for doing all of the work that the Executor has to do. Your Mother can make an arrangement with an Estate Attorney in the BVI to pay that attorney when the Probate is settled. Your Mom does not have to pay upfront. What your Mother chooses to do with her inheritance is her business, not her family's business.. As a side comment: What state does your Mother live in? Most states list an Inheritance as the "sole and separate" property of the heir or heiress. This is even true in California which is a Community Property state. As long as you Mother puts any inheritance into an account with her name on it only, then it is her money only. You Mother needs to open an account that hers and hers alone. If she puts that money into a joint account for even one day, then the inheritance money becomes money that must be divided in a divorce.. Do something wonderful for your Mother. Get your siblings together and buy her a ticket to go to the BVI so that she can see to her inheritance without the "help" of her siblings.

if he is not of sound mind he cannot sign a power of attorney. . if the doctor at the mental home says he is capable of signing a Enduring powerof attorney. then all you need do is go and buy the document from a legal stationery store fill it in and have the doctor witness the signature your brother and that is it. you do not require a solicitor or no court to do anything at all. . take no notice of all the rubbish about CAB and courts etc it is the doctor who will give the go ahead no one else.. taking out a POA is quite easy when someone is in resedential care even the social worker can attest to the signature if the person is deemed to know what they are ACTUALLY DOING the social workers will even interview him to make sure he understands the consequences.. should take about 20 mins to get it all done and dusted.
